Would an of the healthcare proposals presented by the House and Senate abridge the rights or powers protected by the ninth and tenth amendments?

That is exactly what the courts are going to decide.

But most legal experts say no, the healthcare reform package does not violate the constitution, and the Republican states are filing this lawsuit as a political stunt.

    The ninth amendment says that the people have more rights than specifically listed in the constitution. In other words it is impossible to list all the rights we enjoy in the constitution, so we have more rights than the constitution list.

    The tenth amendment says that if a right isn’t listed in the constitution as belonging to the government, that right belongs to the states and the people.

    I don’t understand how it abridges the rights mentioned in the 9 th and 10 th Amend. Health Care is granting you a new right. The right to health care, it is not taking a right away.
